Ever since disabled man Geoff Meeghan was trapped in an Atos assessment centre a week or so ago when a fire alarm went off at the centre there’s been much discussion about the accessibility – or otherwise – of the buildings that Atos is using to hold work capability assessments for the employment and support allowance. ESA is a disability allowance, so it follows that a lot of people who must attend work capability assessments are wheelchair users and/or people who have mobility problems. You’d think that at the very least, buildings would be properly adapted to make entering and leaving those buildings as easy as possible for everyone.

Au contraire.

I took the video below in September when I accompanied DPAC campaigner Patrick Lynch and his carer Stephen to the assessment centre in Archway where Patrick’s WCA was to be held. I’ve uploaded it here to give you an idea of the rubbish which passes for accessibility in some of these centres.

As you’ll see in the video, the front doors at the centre wouldn’t open. A woman who was smoking a cigarette out the front came over to show us how to open the doors – she pulled them open with her bare hands. The “lift” was a single platform squeezed into the right-hand side of the groundfloor entrance. To call the lift, we had to hold the call button down and keep it held down. The door into the cupboard (which it was, literally) which housed this platform opened outwards, into the path of the wheelchair. Once inside, the platform only started moving when the call button was held down. It certainly took more than one person to operate everything.

I don’t know what would have happened if there had been a fire. Using this lift for escape purposes would have been challenging, all right, especially if you tried to fit more than one wheelchair in it. There may have been a brilliant, if not brilliantly obvious, escape route out back, of course, but if there was, nobody told us about it. Would we have had to find it ourselves?

ESA appeals are up by 40% and 425,000 are awaiting ‘assessments’. This coupled with the news that 76% of people going through this horrendus ‘assessment’ are entitled to ESA after appeal figures are computed shows yet again , that the system must be scrapped-its a black hole for tax payers money and something much, much worse for disabled people going through this system. see also the DPAC, Black Triangle, SWU report on survey responses on the WCA.

The appeals figures were provided by Nick at Mylegal who has been doing some fantastic work on the DWP figures to develop the numbers that they dont feed to the newspapers. Once again DPAC is grateful to Nick for letting us repost.

DWP statistics February 2012The DWP & Ministry of Justice throughout the pre-enactment stages of both the welfare reform and legal aid, sentencing & punishment of offender’s bill (LASBO) consistently reported that the number of appeals for Employment & Support Allowance was falling; I have to confess I never believed a word of it. Yes it’s true that the numbers of appeals received at the HMCTS Tribunals had fallen from a record high of 197,400 in 2010/2011 to 181,100 but these are only receipts of those which the DWP has dispatched to the Tribunal.They’re not so keen to tell you that now the dust has settled on the welfare and legal aid reforms, the floodgates are once again open with appeals on the rise; this time by a massive 40% according to HMCTS for the first quarters of 2012/2013.

You can refer to an article on Mylegal where I reported on the appeal statistical ‘spin’ by the MOJ at the time. From which you may note no less than 194,200 cases were ‘outstanding’ in 2010/2011 which had reduced to 145,200 by 2011/2012. HMCTS has increased the number of judicial sitting days from 47,900 in 2008/2009 to 88,700 in 2011/2012 to cope with the escalating number of appeals. The accent at HMCTS was on disposing of the cases which had built up rather than dealing with even more new ‘receipts’.

Employment & Support Allowance is the first benefit of its kind to have an ‘assessment phase’. The numbers ‘awaiting assessment’ have been consistently under – quoted by ministers who continually refer to limited data sets relating to far from the overall number of claimants who have been subject to DWP and Atos assessment. On Mylegal a full report into incapacity benefits & Employment & Support Allowance has been prepared which deals with all the complexities of the DWP assessing 1.5 million claimants a year with 740,000 Atos assessments per year. You can refer to the evidence given to Parliament by Permanent Secretary Robert Devereux which backs up these figures.

With thousands upon thousands of assessments being conducted by both the DWP and Atos it’s plainly obvious that there is a danger of the numbers of claimants awaiting assessments getting out of control and that is what I contend has clearly happened here. What’s more we could be looking at more than the 424,170 assessment phase claimants recorded in February 2012. A Parliamentary note which you can access using the link here shows the figure was 401,100 in November 2011 so we know it’s not falling.

The figure could be over half a million; here’s how..

In the course of preparing a batch of appeal cases which I’m working on I picked out six of the six Employment & Support Allowance cases which are coming up for hearing in the near future. Take a look at the time they’ve taken to come up for appeal but also note the important differences between the IB to ESA conversion cases and the new ESA claim cases, note in particular how the commencement of the ‘assessment phase’ is very different in the 4 conversion cases than it is to the 2 new claim cases:

From the above six cases you will see how five cases have been waiting for a whole year before coming up for an appeal hearing – one case taking longer than 15 months! In the conversion cases you will see how in say Mr O’s case he first entered the conversion phase on the 19/10/2011, was then examined by Atos on the 06/03/2012 before a ‘conversion decision’ was eventually made on the 15/03/2012. Thus in his case he has spent almost five months in the conversion phase and only enters his ‘assessment phase’ on the 15th March 2012 with a further wait of over 8 months before his appeal comes up – it’s an absolute outrage that people are being kept waiting so long.

Let’s take a look at how these conversion cases go missing from the mainstream publication of reassessment statistics:

Which is surprising because this is the statistical data set which relates to claimants undergoing reassessment from their incapacity benefits over to Employment and Support Allowance. By clicking the link you will see the figure of 424,170 relating to the overall number of assessments live as of February 2012; you will also see how it is broken down:


  • 370,470 claimants who are ‘non incapacity benefit reassessment’And
  • 53,700 ‘incapacity benefit reassessment’ cases.


This completely backs up my point over how thousands of incapacity benefit reassessments are not being tracked in the figures available on the DWP data sets. The 53,700 figure for ‘incapacity benefit reassessments’ only refers to those who have appealed. It will not for instance include any of the 4 conversion cases which I have cited from when the four claimants were sent their conversion notice.

The four claimants which I have cited will not appear as an ‘assessment phase’ statistic until such times as they they get their conversion decision and appeal against it. Thus in Mr O’s case all the time he spends in the conversion phase from the 19/10/2011 to the 15/03/2012 is not counted as assessment despite him being assessed by Atos during what is quite obviously part of the overall assessment process.

The statistical guidance confirms this:

“IB reassessed claims shown on ESA in the Assessment phase are those found fit for work and are under appeal.”

With the DWP proudly proclaiming how it’s assessing incapacity benefit claimants at an incredible rate of 11,000 per week (about 47,000 per calendar month) since March 2011; a figure of 53,700 in the assessment phase just doesn’t stack up especially when you compare it against the 370,470 in the ‘non – incapacity’ groups. There must be literally thousands who are in the conversion phase who are not appearing in the Employment & Support Allowance reassessment statistics. They are not identifiable within the following claimant count but they form part of the incapacity benefits & Severe Disablement Allowance (February 2012) statistics (just click to view):

Which is shocking because they should be readily identifiable; they are within the statistics but none of the thousands of incapacity benefits claimants going through the DWP’s conversion phase will be recognisable within the above statistics despite them being subject to the rigours of form ESA filling and thousands of Atos assessments which fill them with absolute fear. They appear merely because the DWP has to track the claimants they pay; they seemingly don’t keep tabs on the true status of their claim within the reassessment programme.

But it gets worse, much worse.

98.4% said that they would prefer the WCA to be recorded

Almost 70% were not aware that they could ask for a recording. The lack of any mention of recording of the WCA in the Atos literature helped the ‘lack of demand’ issue.

For those that had asked for a recording but were refused one almost half 40% were not given a reason for the refusal of the remainder: nearly a quarter (24.5%) were simply told they were not allowed a recording, 20% were told the machines were broken and the remainder were told Atos staff did not like recordings.

Of those refused a recording 65% were told they must attend their appointment without recording or be classified as a ‘no show’. While 23% were not aware that a recording would not be carried out until they arrived at the assessment centre where they faced the choice of returning home and risking loss of benefits or staying and going through the assessment without recording.

74% said that it was difficult for them to travel to the assessment centre, we heard from those who were sent for assessments away from their closest centre with complicated travel routes

Almost half (47.5%) were not aware that they could ask for a home assessment, of those that did and asked for a home assessment none believed they received a satisfactory response to the refusal to grant a home assessment

64% of those that said their doctors were told not to provide written support said this was because of the Department for Work and Pensions (DWP)

Some respondents said that the DWP had written to their doctors to tell them not to issue ‘fit notes’ or written support, others that doctors resented such directives and would supply these based on their expertise and knowledge of the individual.

The survey drew 733 responses. It asks questions that were not asked in the Harrington review, questions on issues of recording, access, doctors input and the apparent increasing influence of the Department for Work and Pensions (DWP) on doctors’.  As such it represents the first evidence based research report on these issues.

The responses contribute to a growing list of criticisms on the experiences of the WCA, welfare reform/cuts and their impacts on the lives of disabled people. It also adds to the growing list of criticism against Atos the company contracted by the Government to carry out assessments, at the cost of 1.10 million pounds per year. Significant concerns are being raised on the financial cost of appeals against Atos WCA decisions, currently running at 60-80 million per year[1], but it is the human cost of suicides and premature deaths rising from 32 per week to 73[ii] a week of those undergoing this process that represents a larger cost. It is a UK outrage that these assessments continue.

The survey responses show the tricks, barriers and bullying tactics used to prevent audio recordings. How difficult home assessments are and how centres, access and travel are made problematic and the ways that doctors input is being ignored and appears to be increasingly directed by the Department for Work and Pensions. The survey is a collection of the ways people are being driven to crisis point, and worse by a system with no clear public accountability. DPAC, Black Triangle, and Social Welfare Union, along with the British Medical Association and a growing number of organisations and MPs condemn the WCA and call for its immediate end. We hope the contents of this report will help those who fail to understand why these calls are being made to begin to understand why this is the only justifiable option.

If I filled a benefit claim form in and deliberately lied, misled with my answers and omitted information / events relevant to my claim with the view to gain financially – I would have my ass hauled into court on charges of benefit fraud. The DWP and ATOS are doing exactly those things with the farce they call an assessment and are both gaining financially by, dare I say, producing fraudulent reports when assessing peoples eligibility for benefit. I suggest people pool together, write statements describing their experience with ATOS and the assessment, highlight the discrepancies between what was said / happened in the assessment and what was written into the report .. and when enough statements are gathered, hand them to the top cop in the country and demand they launch an investigation into the activities of both ATOS and the DWP on the grounds of fraudulent behaviour.

Seventy- six percent of those going through the WCA were entitled to ESA support after appeal figures were taken into account. This obviously does not include who did not have the energy to go through yet another appeal, or those included in the 73 deaths and suicides per week happening as a result of the WCA regime. We expect the percentage would be even higher without the misery and death surrounding this constantly criticised regime imposed by the Government of millionaires. We ask when the media will start producing the correct after appeal figures and we call on MPs to take these into account and help smash the myths around this process which still leaves disabled people without income, suicidal, dead and on the verge of homelessness. If this was happening in any other country this Government would denounce it and call for an urgent inquiry – why are disabled people in the UK still enduring this process?

What the DWP don’t want
you to know

The following percentages reflect the monthly figures for claimants who were awarded their Employment & Support Allowance upon ‘conversion’ from Incapacity Benefit, Severe Disablement Allowance and Incapacity ‘credits’ for incapacity. They are taken from the data table sets released by the DWP on the 6th November 2012 (see above) relating to the first statistical release of figures since the National roll out of the reassessment programme after the Aberdeen & Burnley pilots conducted from October 2010.

These figures are a far cry from the grossly distorted media headlines
depicting ‘75% of incapacity claimants as faking their illnesses’

They also raise concern over claims made by the DWP Press Office yesterday that the numbers being declared entitled to their benefits after reassessment was 64%. Their figure of 64% was arrived at by averaging the 3 months from December 2011 – February 2012, you can see from the figures below that they chose the three months which provided them with the lowest award percentages.

The DWP will of course know how these figures will increase even further once statistical information is added for appeals dealt with by Tribunals which have yet to be confirmed by statistical data releases from Her Majesty’s Courts & Tribunals Service (HMCTS). The figures are adjusted to take account of appeals; some of which will be resolved by the DWP at the reconsideration stage whereas others will be subject to appeals to tribunals for which the data has yet to be added.

Below are figures for claimants who previously claimed incapacity benefits but were then placed in either the ‘Work Related Activity’ or ‘Support’ Groups in Employment & Support Allowance once their awards had been converted – they make interesting reading:

We do not believe that any individual or group who claims to represent the disabled people’s protest movement should engage with DWP/Atos/Capita without insisting upon an end to the Work Capability Assessment (WCA) with immediate effect as a prerequisite to any discussion.

 We regard any such engagement with DWP/Atos /Capita without this insistence on the above as a prerequisite to be nothing less than collusion in policies and systems that have been irrefutably shown to be harmful and, in many cases, lethal to the sick and/or disabled person being ‘assessed’.

 The WCA has no empirical, scientific medical evidence-base and the process has never been risk assessed.

 There remains no feedback or reporting mechanism.

 The discharge of both a statutory and ethical duty of care – owed by professionals, citizens and public authorities – to others in a vulnerable situation depends upon the existence of a reporting mechanism whereby any potential or actual risk to the life and well-being of a patient or to those around them may be reported and adequately addressed.

 This is precisely why the entire British medical profession has demanded that WCA end ‘with immediate effect to be replaced by a rigorous and safe system whereby avoidable harm’ may be prevented.

 That the General Medical Council (GMC) continues to accredit Atos assessment centres with ‘approved medical environment’ status is an utter disgrace.

 The Work Capability Assessment has caused death, suicide, homelessness, and left people without income dependent on family and friends. The WCA also causes an increase in mental health issues and a worsening of impairments. The latest figures show 73 deaths and suicides per week amongst those subject to this brutal process.

 The WCA is based on the discredited UNUM manufactured bio-psychosocial model. The   Centre for Psychosocial & Disability Research at Cardiff University literature has provided the academic foundation for the increasingly notorious WCA administered by Atos Healthcare in the UK, and without it is unlikely that the WCA would exist in its present form. The volume of incriminating evidence against the WCA has grown phenomenally, as people with serious, incapacitating illnesses continue to be found ‘fit for work’.

 When Freud set out his vision of welfare reform for disabled people he used a number of references to back up the plans for reforms.  No less than 170 of these references came from a group of academics based at or connected to the Cardiff University Department:. This centre originally led by ex Chief medical Officer at the Department for Work and Pensions Sir Mansel Alyward was funded by Unum to the tune of 1.6 million pounds from 2004 to 2009 to add academic credibility to the bio-psychosocial model: a model used by Atos to identify that if someone can press a button they are ‘fit for work’ and ineligible for any disability support.

 The connection between the WCA and the Cardiff Centre are only too obvious. The latter seeks to locate the source of incapacity in the individual’s psyche/attitude, promoting a form of ‘positive thinking’ as being curative, while the WCA claims to focus on what sick/disabled people can do as an argument that they have even the merest work capacity. But there is a more important connection. The Centre’s funder, Unum Insurance, employed tactics of ‘disability denial’ in the U.S. to avoid paying out on legitimate health claims. And since founding the CPDR Unum have sought to promote their ‘Income Protection’ product, marketing it upon the fact that the British public can no longer rely upon the state to support them if they become sick or disabled. Are we really to believe this is a coincidence?

 DPAC and BT want to state categorically:

 1. We reject all ideas that ‘tinkering’ with WCA descriptors will serve any positive purpose. We call for the complete removal of the WCA with immediate effect and we have remained unwavering and constant on that position.

 2. We reject the bio-psychosocial model as having any purpose but to cut state support and replace it with private insurance and other company profits.

 3.We work from the social model philosophy and this means a pan impairment approach with no hierarchy of ‘deserving’ and ‘undeserving’ groups or individuals; this is in complete contrast to this government, or any set of groups intent on taking us back to medical model terminologies or helpless victim approaches

 4. We will work with any group who we believe genuinely opposes the government’s attacks on disabled people. However we are seriously concerned with those organisations who believe that they can work with the government to lessen the effects of these attacks. We believe that there is no alternative to outright opposition to the government if we are to stop the impoverishment and destruction of the lives of millions of disabled people in the UK. We are particularly disturbed that some of the large disability charities seem willing to work with the government effectively giving cover to their attacks on disabled people. We call on all disability charities and other groups to immediately withdraw from any work that lends credibility to the government’s so called welfare reforms.

 5. We do not support in any shape or form what this government is doing to disabled people: we classify disabled people as those who have to endure the negative attitudes of others, and those disabled by the ways this so called society treats us as less deserving than non-disabled people. We support an assessment that truely establishes a person’s ability to assess their capability to work, not based on a tick box approach.

A successful conference held in London on the 27th September called for a new UK network to challenge the attacks on disability rights in the UK. The conference supported by DPAC, Inclusion London, ALLFIE, Norfolk Coalition of Disabled people and the Joseph Rowntree Trust brought together leading Disabled Peoples Organisations and leading disability activists.

Key speaker Jenny Morris said that the ‘disability movement’ was more vibrant than ever, and that this Government had launched a number of attacks on disabled people and their rights. However others suggested that there may not be a disability movement anymore, but pockets of activity. What was clear was that challenges by disabled people and disabled peoples’ organisations (DPOs) must increase. Speakers also raised issues of how ‘the movement’ could be more inclusive in the speakers ‘from the frontline’ slots.

DPAC was there to add commentary and information on what was happening to disabled people under the regime of Atos and the ESA processes as well as the everyday crisis disabled people were facing under this Government. The whole day was brilliantly co-chaired by Tracey Lazard ( CEO of Inclusion London ) and Tara Flood ( director of the Alliance of Inclusive Education) . Speakers included Jenny Morris, Andrew Lee, Eleanor Lisney, Chris Edwards, Debbie Jolly, Linda Burnip and Geraldine O’Halloran, yet, there was also plenty of time for discussion.

When George Osborne was booed at the Paralympics it was the clearest expression yet of the anger building up against the Tory / Liberal coalition’s welfare reforms, and their treatment of disabled people and those who are ill.

 The death of cancer patient Cecilia Burns on 27 August and her treatment by the benefits system managed by the Department for Work and Pensions and in part the private company ATOS Healthcare illustrates the nightmare situation anyone can find themselves in if they become disabled or fall ill.

 While undergoing treatment for breast cancer, Cecilia approached the state for help. She was subjected to the new Work Capability Assessment (WCA) system that was introduced in October 2008 alongside Employment and Support Allowance. This resulted from New Labour’s long-term policy of reducing the numbers on incapacity benefits by one million.

 The WCA, which is administered by ATOS, usually lasts about 15 minutes and uses a points system that looks at how a person is able to function physically, intellectually and socially. This assessment is so flawed that at their conference in May 2012, representatives of Britain’s 44,000 General Practitioners voted to campaign to end it.

 Like hundreds of thousands of others, Cecilia was badly let down and told despite her ongoing treatment she was ‘fit to work’. Her benefits were reduced by about £30 a week. At a time when Cecilia should have been allowed to concentrate on her health and be free of pressure, she had to appeal this decision. Her appeal was successful and she had her benefits restored a few weeks before her death.

 Cecilia said herself:

I was treated badly. I’ve been working since I was 17, I’ve paid all my stamps, all my National Insurance. The only time I was ever sick was when I was pregnant with my two sons. It has had a financial effect on me but it’s more (that) they’re getting away with it. They are just treating you like a second class citizen. That’s how I feel – that I don’t count, I don’t matter.”

What Cecilia Burns went through could easily be experienced by your mum, dad, sister, brother, aunt, uncle, son, daughter, partner or you.

 Even those disabled and ill people who are assessed as being unfit for work are facing the prospect of fines of £71 a week if they fail to take part in work-related activities such as training or ‘condition management programmes’.

 At present about 70,000 claimants lose some or all of their benefits every month when they are sanctioned. The WCA is resulting in people being found fit to work who very few employers would ever consider giving a job to. People with moderate and mild learning disabilities, long-term and enduring mental health problems, and other complex conditions find it difficult to understand or complete the tasks demanded by the jobseekers benefit system. They face losing benefits for months for failing to do enough to find work they’ll never get.

 Disabled people have had enough and are fighting back. Disabled People Against Cuts organised 21 protests against ATOS on 28 August, and several other high profile protests in London during the Paralympics.

 ATOS has made hundreds of millions from running the Work Capability Assessment for the DWP, and is now about to heap more misery as they reassess millions of disabled people for the new Personal Independence Payments. We call for the WCA and recent Welfare Reform Acts to be scrapped, the DWP’s contracts with ATOS to end immediately, and the introduction of a more humane and compassionate welfare system.

 One person’s nightmare……

 I became disabled when I was hit by a car during my first year at University.  The collision put me in a critical condition with multiple injuries including a severe brain injury.  I survived the accident but was left with permanent disabilities as well as suffering from epilepsy.

 
I had wanted to study Law and become a Solicitor, but my disabilities have made that impossible.  In fact my disabilities, combined with the psychological trauma I suffered, have meant that I haven’t worked since my accident.
 
Until recently I was claiming two benefits, Disability Living Allowance as well as Incapacity Benefit.  My benefits didn’t amount to much but at least they allowed me to lead some kind of life.  Earlier this year that all changed when ATOS called me in for a Work Capability Test.
 
I was so angry when I first received the letter from ATOS.  After attending a Work Capability Test I was passed fit to work by ATOS and had all my benefits stopped.  ATOS made their decision based on a 15 minute interview.  They never contacted any of the medical professionals treating me; they never even researched my case history. 
 
Now I face a lengthy and stressful appeals process against ATOS.  I’m being treated for depression and at times have experienced suicidal thoughts.  ATOS never seemed to care what affect their ruling would have on my health or on the health of those around me.

An email to DPAC yesterday

I failed in my attempt to overturn the appeal decision against me at tribunal. I was not even allowed into the tribunal to state my case. Upon arrival at the tribunal site a receptionist took my name then informed me that I didn’t need to be there and I could go straight home. Two days later a letter arrived saying I had lost. I think the decision had already been made.

This morning (20th Sept)  I found my ESA claim had been stopped on August 20th, they didn’t write and tell me, I only found out when I tried to pay my bills. I now have to start a new claim, possibly attend another WCA.

Basically I think I am just going to have to go through the whole cycle again. My only option was to apply for a crisis loan. When I listed my expenses for the next two weeks it came to just over two hundred pounds at a bare minimum, they could not include prescription costs. They suggested I commit fraud by ticking the box saying that I receive ESA when they’ve stopped it. I have no other choice as, out of my anticipated expenditure for the next fortnight, they will loan me £42.

Having read of disabled people losing claims I didn’t think I would be in the same boat as my doctor gave me a new sicknote for three months on 13/9/2012 and I have followed their procedure to the letter. My new sicknote counts for nothing. I can’t describe how pissed off that today’s rigramole has got me and I have no idea what I will do for money. Feel free to use my example for your campaign, perhaps if other claimants are forewarned that they’re gonna lose whatever they do or whatever evidence they provide and they can lie and cheat to get what they should be rightfully entitled to. I’m sorry to tell you my woes, I hope my example can be used in a positive manner for people going through this farce.

Section 102 and Schedule 11 Welfare Reform Act 2012 – Power to require consideration of revision before appeal

 Section 102 and Schedule 11 of the Welfare Reform Act 2012 legislate for the following changes to the Employment and Support Allowance (ESA) and Disability Living Allowance (DLA) appeals process:

 Ÿ  Under the new rules, due to be implemented from April 2013, claimants who wish to challenge a benefits decision will no longer be allowed to choose to lodge an appeal immediately.

Ÿ  Instead, there will be a new requirement for claimants to request a revision of the original decision from the Department for Work and Pensions (DWP) and have that request determined before launching the right to appeal to an independent tribunal.

Ÿ  Only once the decision maker has either issued a revised decision, or decided that they cannot revise the decision, will the claimant be able to lodge their appeal.

Ÿ  There will be no time limit on how long this process can take.

 DPAC is very concerned at the harmful impact these changes will have on many claimants:

 Ÿ  The new bureaucratic tier in the appeal system has the potential to cause confusion for many claimants and lead them to make the wrong appeal to the wrong people at the wrong time, leading to inevitable problems with the payment of their benefits. Some disabled people may even withdraw from the appeals process altogether. The current appeal system is already a highly stressful, time-consuming process, resulting in considerable instability in many people’s lives and finances. The addition of a mandatory review stage, with all the attendant uncertainties, can only exacerbate these problems. DPAC is not convinced that the addition of a mandatory revision stage will in any way increase the efficiency of the system.

Ÿ  This problem will be heightened by the fact that there is no statutory time limit for the revision stage. This could lead to indefinite delays to the process while the DWP revises the decision. There is already no time limit in the current system, so adding another stage can also maximise delays, with, once again, a corresponding adverse impact on the health and well-being of the claimant. This could be alleviated if there was a maximum set period for the review process. This would at least provide the claimant with some level of certainty.

Ÿ  Around 40% of all WCA appeals are currently successful with 70% sucessful with representation which is a damning indictment of the quality of ATOS Healthcare’s initial assessment. Tragically and scandalously, many people who have initially been found fit for work have actually died before the appeals process was completed. With the extension of the time frame for appeals that this change will introduce, and no perceivable improvement in the WCA itself, this number can only rise even further.  

Ÿ  It is also unclear how the new process will deal with the payment of ESA during the new mandatory revision stage. Currently, a claimant appealing against a decision that they do not have a limited capability of work is able to continue to receive ESA at the assessment phase rate pending the outcome of their appeal. However, if the ESA Regulations are not amended, the position would be that claimants would have to claim Jobseeker’s Allowance (JSA), and therefore comply with all the conditions associated with receipt of that benefit,  or face receiving no benefit at all. Many claimants with severe conditions would simply be unable to fulfill the JSA conditions and therefore face a very real prospect of destitution. This would be inhumane and lead to a catastrophic increase in the amount of distress, poverty and debt many disabled people already suffer from. The Government should therefore, as a matter of urgency, provide clarification on whether it intends to allow ESA claimants to continue to receive ESA at the assessment rate while they undergo the mandatory revision stage.

Ÿ  The fundamental problem is that the WCA process is itself fundamentally flawed and it this broken system that needs to be completely overhauled. The standard of the initial medical examination, and the information provided to the claimant on their WCA decision, need to be drastically improved before any needless tinkering with the appeals system is introduced.

 The Government consulted on the implementation and operation on the appeals reform provisions from February to May this year. The consultation, though, did not ask for responses on whether the mandatory reconsiderations should be introduced. The Government revealed, in its interim response published in June, that it had received 154 responses to the consultation but indicated that it “does not propose to make any significant changes to the draft regulations included in the consultation document as a result of the comments received“. DPAC calls on the Government to publish a full response to this consultation as soon as possible so we can ascertain the evidential basis for this change and just how much support the proposed change has received from respondents.

Disability Law Service

Who are they?

A national charity run by disabled people, which specialises in free legal advice and information for disabled people, their families and carers.

What do they do?

They provide free legal advice and representation (e.g. in complaints, using the Ombudsman, tribunals and courts), specialising in Welfare Benefits; Community Care; Disability Discrimination in Employment, Access to Goods and Services; and using the Equality Duty to challenge public authorities.
They run a free legal advice line, open Mon-Friday, 10am–5pm, with an answering machine service for out of hours calls.
They run an Employment Law drop in at their office in Tower Hamlets, where a member of their legal team will assess whether you are financially eligible for legal aid under the Legal Services Commissions (LSC) Legal Help scheme.
They also have factsheets available to download on key areas of the law, such as Community Care; education; employment; goods and services; and welfare benefits. The factsheets are available for download in different formats – regular, large print, text only and audio file.
They commit to responding to telephone enquiries within 24 hours, and written enquiries within 7-10 days.

Who are they?

A dedicated legal advice service for Deaf BSL users provided by the Royal Association of Deaf People (RAD).

What do they do?

RAD Legal Services currently has three projects: a Discrimination Advice project, a Webcam Advice Project and a Money Advice Service project.
Discrimination Advice gives free specialist legal advice on discrimination issues in the areas of employment, housing, education and goods, facilities and services.  This is provided by a Deaf solicitor, and can be delivered face to face, via webcam, email, telephone or instant messaging software.
Webcam Advice is the BSL version of the Community Legal Advice Helpline, and is available free of charge to people eligible for legal aid in the areas of welfare benefits, debt, housing and employment.  As well as webcam, they can also provide advice via instant messaging software such as Windows Live Messenger, ooVoo, etc.
Money Advice Service has a qualified Money Adviser giving free, clear and ‘jargon-free’ Money Advice money advice to D/deaf and hard of hearing people who live in the South East. The Service covers the savings and investments; borrowings (credit cards, loans and mortgages); retirement planning and pensions; redundancy; tax and tax credits; insurance; debt; starting a family; and budgeting.

Atos claim that 90% of people surveyed ‘are positive about their experience with us’. Yes, this is on WCA! The claim is apparently from their monthly survey of 2,500 people- odd then that an estimated 11, 000 people a week are going through this horrendous process =44,000 per month. They say:

Independent reviews have confirmed that we are providing a high standard of service in our WCA role and in our monthly survey[1] of over 2,500 customers, 90% of those who respond are positive about their experience with us. We are the first to recognise that in a role as complex and challenging as this, it is also our day-to-day duty to look for ways to improve any aspect of our work.

It would be inappropriate for Atos Healthcare to comment on the government’s procurement process, but the company welcomes competition in the healthcare sector as with all other areas in which we operate.

In an answer to a parliamentary question on Atos from Frank Field (lab) Chris Grayling said:

“Based on the results of a trial during 2011, we have not implemented universal recording for claimants going through the work capability assessment (WCA).
We have asked Atos Healthcare to accommodate requests for audio recording, where a claimant makes a request in advance of their assessment.
This approach began in late 2011 and we will monitor take up during 2012 before making a decision on the requirement for recording assessments, taking into account factors such as value for money and the value it adds to the WCA process. As part of this process we are also reviewing Atos capacity to provide recordings for those claimants who currently request one”.

We at Disabled People against Cuts (DPAC), Black Triangle and Social Welfare Union (SWU) want to make sure that we gather the REAL facts on what people are experiencing. We suspect that the government will try to pull the option for recordings of WCA completely due to what they will say is a lack of demand, so we have put together a short survey to gather information on the demand for recordings and on other issues on the WCA.

An application has been made by members of the Mental Health Resistance Network for permission to have a Judicial Review of the Work Capability Assessment (WCA) and a judge has decided that there should be a hearing to decide whether to grant us the Judicial Review.

The hearing will happen at the Royal Courts of Justice in the Strand in London on Friday 29th June. We won’t know until the day before what time it will be heard. 

With thanks to MHRN for letting us publicise this. It is MHRN who have pushed this through, not any big charity -remember most activism is coming from grassroots groups-rather than well funded charities who like to try to claim the credit.

Lets support MHRN as much as we can with this great achievement on 29th June-hopefully the first of many challenges to the corrupt WCA…..

This is an important and urgent message from the Mental Health Resistance Network.

As you all know, members of the Mental Health Resistance Network have been working with a solicitor towards making a claim for a Judicial Review of the Work Capability Assessment (WCA) which is the assessment used to determine whether we will be granted Employment Support Allowance or sent back to work (if there is any work to be found!). We are just focussing on people who claim on mental health grounds.    

We are now at a critical stage in this process as we are very close to being able to make the claim for Judicial Review. However, before we can do this, it would help if we could find stories that will show the court what sort of problems the WCA causes. So we are looking for people who have been through the process and would be able to tell us about their experience. If people wish, we can present their cases anonymously when we use their evidence. Although it would be very good if people were prepared for us to give their names to the DWP so that the DWP could check their stories, it is not essential.

There are two types of experience that we are particularly interested in (in the solicitor’s words):

 (i)  Cases where a person claims ESA without producing any medical evidence and is refused benefit, but then wins on appeal when medical evidence is obtained.

(ii)  Cases where a person claims ESA without producing any medical evidence, is refused benefit, does not appeal (perhaps because they can’t face it), and then bad things happen (for example they go into work and become ill, or have a problem, or can’t get work, or whatever). Ideally, the case is recognised down the line as a problem because a CAB or law centre makes a new application with medical evidence and benefit is awarded.

In other words: 

1) you have you claimed and been turned down for ESA but were successful on appeal when you produced additional medical evidence 

 or 

2) were you turned down for ESA and did not appeal but reapplied with medical evidence, and were successful.

This website provides information on how Atos runs its business, extracts from the Contract between the DWP and Atos including the MEDICAL CONDITIONS that mean a face to face medical assessment is not always necessary, ASSESSMENTS AND POINTS, the breaches of Contract that occurred in my case, my unsound medical report and the correspondence showing how difficult it is to obtain justice or advice.

 

The Government is inviting the public to submit petitions. Atos Origin IT Services UK Limited (Atos Healthcare)

Atos Origin appears to have followed the approach of the discredited Unum company in the US. Unum in the US describes the fines in the US for operating “disability denial factories”. Unum in Wales describes Unum’s funding of the activities of Professor Mansel Aylward, the former Chief Medical Adviser at the DWP and head of the UnumProvident Centre, Cardiff University. Unum in the UK describes their activities in the UK including their contributions to creating the regulations that implemented the Welfare Reform Act.

In 2001 Schlumberger bought SEMA for $5bn. In 2003 Atos Origin bought Schlumberger SEMA, an IT Services company. At that time the Atos Origin had 50,000 staff and annual revenues of €5bn.

Reuters reported in February 2010 on KPMG. It mentioned that KPMG sold its original consulting practice to IT services group ATOS Origin in the wake of the Enron scandal (https://en.wikipedia.org/wiki/Enron_scandal). Many executives at Enron were indicted for a variety of charges and were later sentenced to prison.

Atos Origin has such a poor track record. The examples below are just a few of those that highlight the way this company is managed and operates after the DWP hired Atos Origin.

Atos Healthcare conducts DWP disability assessments for people claiming a range of disability benefits including Employment Support Allowance, Incapacity Benefit, Disability Living Allowance, and Industrial Injuries Disablement Benefit. Each year we process over 1.2 million referrals for medical advice and provide over 800,000 face-to-face medical assessments via our nationwide network of over 140 medical examination centres.

Atos Origin IT Services UK Limited are on the Goverment’s preferred supplier list. Why? Seriously ill cancer patients are being forced to undergo “cruel” back-to-work interviews despite the fact they should be exempt, charities warned today.

Those who are terminally ill or undergoing chemotherapy or radiotherapy are being threatened with benefit cuts if they do not attend the meetings, according to Macmillan Cancer Support and Citizens Advice.

The “fit for work” interviews are for people seeking the employment and support allowance (ESA), which replaced incapacity benefit and income support in October 2008.

An investigation is underway after a memory stick with user names and passwords for a government computer system was found in a pub car park, leading to the shutting down of the website as a security precaution.

With critics lambasting the latest security breach, the Prime Minister intervened in the affair to say that the Department for Work and Pensions would be taking action and the company which lost the information, Atos Origin, could face changes to its five year contract worth 46m.

The memory stick lost in the latest incident was found in the car park of the Orbital pub in Cannock, Staffordshire, where Atos Origin is based.

UP TO 900 people are to be recalled for medical scans after a series of blunders by a private company.

NHS bosses last month suspended tests being carried out by Atos Origin at centres in Manchester, Salford, Bolton, Stockport, Oldham, Wigan and Liverpool, after discovering technical and administrative problems.

Now regional health bosses are set to write to the 900 patients who had ultrasound tests to investigate conditions like kidney, prostate and abdominal problems at Atos centres to offer them the chance to be re-scanned at NHS hospitals or private companies.

Following complaints by a former GP at the privately-run NHS Walk-in Centre at Canary Wharf, the Nursing and Midwifery Council has started an investigation.

Almost 80,000 sick and disabled people a year are being wrongly denied benefits, according to a BBC investigation for Radio Five Live.

It has emerged that medical reports on people claiming some benefits are unreliable or inaccurate.

As a result, thousands claiming Incapacity Benefit or Disability Living Allowance have had to appeal.

The government says that it is “responding positively” when criticisms are made.

The investigation found that some handwritten medical reports were altered so that the meaning was completely changed, while in other cases a computer-based medical questionnaire produced misleading or nonsensical information.

Atos Origin doctors send their reports to civil servants who make a final decision about a person’s entitlement.

Academia

Governments, like companies, like to pick and choose those elements of research that best fits the short term objectives of the time. There are rigorous scientific and engineering disciplines and there are those which are less so. Academics are asking the following questions and similar.

  • Is eugenics scientifically credible even if socially unacceptable?
  • How did eugenics relate to “Survival-of-the-fittest” Social Darwinism?
  • How does “welfare-to-work” and “fit-for-work” relate to Social Darwinism?

Prior to World War 2, there was a widely held view that there was some evidence of correlation between social behaviour and the physical characteristics of individuals. It was suggested that individuals with particular features were more likely be “criminal” types and so, to protect society, should be placed in locations where their activities can be closely monitored. Politicians can influence scientific opinion.

The rational scientific world has seemed to have moved on from the primitive and barbarous view of many religions, widely held until recent times, that sickness is a punishment by a deity and as such is just if prayers or votive offerings fail to cure the sickness. Irrational delusions can influence politicians.

Welfare to Work

The research of Lord Richard Layard and Stephen J Nickell has strongly influenced labour market reforms in Europe.

Lord Richard Layard is emeritus professor of economics at LSE and a Labour life peer in the House of Lords. Stephen Nickell is Warden of Nuffield College, University of Oxford, and was previously a professor of economics at LSE and a member of the Bank of England Monetary Policy Committee.

They have produced ground-breaking work on the relationship between labour market institutions and unemployment. Their research provided a theoretical and empirical framework for the analysis of equilibrium unemployment and the impact of labour market institutions on economic performance.

The “welfare-to-work” approach now adopted by many nations draws on their finding that generous unemployment benefits need not be detrimental if they are granted only for a limited time and are accompanied by adequate instruments that require (and assist) unemployed individuals who are able to work to actively search for a new job.

Other work by Layard and Nickell provides evidence that stricter employment protection regulations do not generally increase the level of unemployment, but increase the persistence of unemployment by reducing short-term unemployment at the cost of raising long-term unemployment.

They have also shed light on the interaction between wage setting institutions and unemployment. In particular, they were able to show that higher union coverage tends to increase unemployment, but these negative effects of collective wage bargaining can be offset if unions and employers coordinate their wage bargaining activities effectively.

Individuals and the state have a duty of care to the less fortunate. Concepts such as “welfare to work” and “fit to work” may or may not be appropriate for the able but it is clear that these concepts can and do place more pressure on the unemployed dying, sick, disabled and their carers.

Social Darwinism, if it means anything, it means weeding out the less strong in society. If this is the intent of Parliament it should be clearly stated. The Welfare Reform Act is not clear in this respect. However the implementation of the Welfare Reform Act by Atos Healthcare appears to conform to the spirit and practice of Social Darwinism.

Civilisation allows man to rise above a “survival of the fittest” world. The judgements handed down at the Economists, Lawyers and Doctors Nurnberg Trials are as appropriate today as they were in 1945.

Fit For Work and Fit Notes

Even as a medical layman, there seems to be some minor medical conditions where “fit to work” assessed though a medical examination undertaken by someone without access to the patient’s medical history or without specialist knowledge might be possible. If my leg was broken and there were no complications and it was taking longer than the time allowed before an ESA form needed to be completed, then a “few simple physical tests” might be sufficient for a “fit to work” assessment.

Atos Healthcare has confirmed in writing to the Health and Safety Executive that their medical assessment comprises only a “few simple physical tests”.

In the real world, the Secretary of State does not give a breakdown of the medical conditions of those denied allowances. If she said what these medical conditions were and she put forward medical experts who agreed with her that a “few simple physical tests” was sufficient to deny allowances, then concerns would lessen. Instead we hear of dying cancer patients and people with autism denied allowances, this is a concern.

Dame Carol Black has called for a new approach to work-related health services, after her review found that ill health was costing the country £100bn annually.

Dame Black has been commissioned by the Department for Work and Pensions (DWP) to advise on how to improve the health of those in work and reduce the number claiming sickness benefits.

Black questioned the current sick note system, which she said concentrated on what people cannot do instead of what they can. She recommended that doctors’ written sick notes should be replaced with an electronic “fit note”, explaining what people were able to do even if they were ill.

Business Influences

At times it seems the UK Government have been influenced more by financial considerations rather than by medical considerations.

UnumProvident in the US

My case suggests that there are similarities between the approach taken by Atos Healthcare and that of UnumProvident.

In 2007 the American Association for Justice named Unum in the top 2 of worst insurers. In 2005 the California Insurance Commissioner described Unum (formerly Unum Provident) as an outlaw company and it is a company that has operated for years in an illegal fashion. Back in 2002, a class action lawsuit charged UnumProvident (now First Unum or Unum) with operating “disability denial factories”. The company also faced thousands of lawsuits filed by individuals who were denied disability claims. Despite jury verdicts against the insurer (in January 2003, a California jury reached a US$31.7 million against UnumProvident and two years later, the California Department of Insurance fined the company US$8 million because it “misinterpreted job classifications, improperly overruled doctors’ opinions and knowingly used incorrect insurance definitions to avoid paying benefits”), Unum continues bad faith insurance practices.

Unum Group (formerly UnumProvident) holds about one quarter of the disability insurance market in the US, making it one of the largest providers of group disability insurance in the country.

In 2004 and 2005, regulators ordered Unum to re-evaluate thousands of denied claims. According to the LA Times (April 12, 2007), the company reviewed less than 10 percent of the 290,000 claims eligible for review and potentially, re-instatement of benefits.

UnumProvident Reaches Settlement with California Department of Insurance; ‘Changing Landscape’ May Impact Cost, Availability of Disability Insurance in State

CHATTANOOGA, Tenn.–(BUSINESS WIRE)–Oct. 3, 2005–UnumProvident Corporation (NYSE: UNM) today announced that three of its insurance subsidiaries have entered into a settlement agreement with the California Department of Insurance, concluding a market conduct examination and investigation of the subsidiaries’ disability claims handling practices. As part of the settlement, UnumProvident has agreed to change certain practices and policy provisions related to its California business and consistent with California case law. The settlement also incorporates claims handling practices previously covered by the multistate agreement reached last year with 48 other states, and includes certain additional claim handling changes. Additionally, UnumProvident has agreed to pay a fine of US$8 million to the Department as part of the settlement.

Added Watjen, “Over the past two years, our company has undertaken broad changes designed to improve the quality of claims decisions and our service levels to policyholders. We made many changes during this time to improve in these areas, and added to those through the multistate settlement that was previously approved by 48 other states. Because of this, we do not believe that California’s allegations or the market conduct exam report, which is essentially a snapshot from a prior period, provide an accurate portrayal of our claim practices today.

Psychosocial and Disability Research (UnumProvident Centre) Cardiff University

UnumProvident Centre provides funding for Psychosocial and Disability Research based at Cardiff University. The Director of the Centre is Professor Mansel Aylward. He is the former Chief Medical Adviser at the DWP and was instrumental in the DWP accepting the UnumProvident concepts applied in the US and was influential in how the Welfare Reform Act should be implemented.

It is bellieved that the UnumProvident Centre has been one of the leading forces in trying to make it harder for allowances to be paid to the dying, the sick, the disabled and their carers. Staff from UnumProvident were important in the design of the Personal Capability Assessment and of the new, much harsher Work Capability Assessment required if an Employment and Support Allowance is to be paid.

Professor Aylward continues to be involved in research for the DWP. He has provided support for Dame Carol Black, proponent of the replacement of sick-notes with “well-notes”.

The UnumProvident Centre carries out research into “presenteeism”. “Presenteeism” is the culture of working ridiculously long hours and not taking time off when sick. Professor Aylward has been quoted that “presenteeism” costs the country ten times more than sickness absence. It seems ironic that in addition he has been quoted as saying, “The problems come from people who are ill, those who are not up to the mark, who are continuing to work.”

The allowance paid for ESA(C) is just under £90 per week. The current “National Minimum Wage”, set in October 2009, is £5.80 per hour. If a 40 hour week is worked, the weekly pay, before tax and NI, would be £232. The unemployed dying, the sick, the disabled and their carers have to live on just under £90 per week and for this amount have to attend repeated assessments and “pathways” meetings.

The key phrase is “The U.K. market is still in many respects underdeveloped…”. In the USA, individual states have a Department of Insurance to protect people from unfair business practices. Perhaps the UK needs a similar body to protect people from similar unfair business practices.

The Atos Healthcare occupational healthcare programme was key in cutting the number of working days lost across the Department by 20% while improving employee wellbeing

London, 14 June 2010, Atos Healthcare, the number one occupational healthcare provider in the UK and a business division of Atos Origin, today announced that it won customer delivery supplier of the year at the Department for Work and Pensions (DWP) Supplier Excellence Awards held in London last week. The award recognises the contribution that the occupational healthcare programme delivered by Atos Healthcare has made in cutting the number of working days lost across the Department by 20%.

Atos Healthcare took over management of the occupational healthcare service for the Department’s 120,000 employees in 2008. Working in partnership with the Department for Work and Pensions, Atos Healthcare has made significant improvements to processes and services. The benefits include returning employees back to work quicker, increasing employee productivity and providing more support to managers to deal with absence issues in a timely and effective manner.

The Occupational Health Service helped DWP reduce its current sick pay bill by around £13m annually and increase staff resource by the equivalent of nearly 1,000 full-time posts. Assessments can now be scheduled within 4 days and customer satisfaction has increased to 91%.

Improvements implemented by Atos Healthcare include the launch of a new web portal to make it easier, faster and more convenient to make an appointment and track cases; and new standards and an audit regime to ensure the quality of clinical advice.

The Department for Work and Pensions re-awarded Atos Origin IT Services Ltd., trading as Atos Healthcare, a new contract to perform medical services on behalf of the Department from 1 September 2005.

The total cost of these services from 1 March 2008 to February 2009 was 80,589,204. This figure not only covers the total number of examinations undertaken across all benefits, but also costs relating to written and verbal medical advice, fixed overheads, administrative costs, investment in new technology and other service improvements.

Using the Atos Origin 11% operating margin stated in the annual accounts for their UK business, the profit is an estimated £8.9 million.

Atos Origin Workload

Using figures given to Parliament I estimate the cost per assessment to be £135. For the work needed, if the work was undertaken as Parliament intended, this amount is far less than should be expected even if National Minimum Wage was paid to all staff involved. The Contract between the DWP and Atos Healthcare specifies “qualified” medical practitioners should be used.

In the 12 months to September 2007, Atos Healthcare undertook 528,380 personal capability assessments.

  • Income (£80.6 million) – Profit (£8.9 million) = Cost (£71.7 million)
  • Cost (£71.7 million) / 530,000 (assessments) = Cost per assessment (£135)

My case should have cost the time for a qualified medical practitioner to review my ESA information and then advise the DWP either my condition was terminal or my medical condition was not yet stable. In both cases the advice should have been to pay the allowance and defer indefinitely Work Focused Health Related assessments and Pathways to Work appointments. Atos Healthcare could have contacted the consultants whose contact details were all listed in the ESA information submitted. They did not contact my GP or my consultants.

If Atos Healthcare had carried out the above procedure and if they used a medically qualified practitioner, as they are contractually obliged to do, it would near impossible to do this work for around £135.

Of course Atos Healthcare decided on a much more profitable approach. In addition to the above they added the costs of making unnecessary appointments and a two hour interview by a medical practitioner without specialist knowledge and without access to the medical history. They added their handling charge of processing travelling expenses. Instead of charging £135 they should be able to charge the DWP at least ten times this amount. Atos Healthcare confirmed to the Health and Safety Executive that they run their operations in standard offices as they do not need specialist medical facilities. A very profitable piece of work for Atos Healthcare.

It is true that the Contract between the DWP and Atos Healthcare specifies that “redo” work will be paid for by Atos Healthcare. It seems that all complaints and appeals and other costs incurred by both Atos Healthcare and the DWP are paid for by the DWP. In my case the need for “redo” work has not yet arisen. A reasonable person might suspect that the motive for long delays in investigating and resolving complaints is to increase Atos Healthcare profits. To quote Dickens’ Bleak House, “Jarndyce and Jarndyce drones on”. If Dickens were alive today perhaps the plot of Bleak House would perhaps be concerned with the business practices of Atos Healthcare.

All the complaints and appeals procedures of Atos Healthcare have to be followed first. Then those of the DWP. Then those of the Parliamentary and Health Services Ombudsman. If Gilbert and Sullivan were alive today, I am sure they would draw attention to the absurdities. Unfortunately too many people are suffering and some of these die before their time, cold and uncared for. When I swooned and near fainted on the Tube after the medical assessment by Atos Healthcare, it would have been a very vigilant Coroner to put as my cause of death: Corporate Manslaughter through the negilience of Atos Healthcare.

will be the end to end recruitment of medical professionals. You will be working
in a fast paced, team environment, delivering a volume recruitment solution whilst
working towards tight deadlines.

As a Recruiter your main responsibilities will involve:
-Using proven negotiation and sales skills to "sell" Atos Healthcare opportunities to

The good news is this was for a temporary position which finishes December 2012. Hopefully Atos have been told their contract is not likely to be extended. It also suggests they have a high turnover of staff. It appears even those, like in my case, who are unable to read and write English up to the standard defined in the Contract are not willing to work for Atos. Who can blame them?

Would you consider a person who became spontaneously unconscious once every five weeks fit for work? Would you employ them? Would you consider them fraudulent if they claimed that this condition was disabling?  In the March 2011 version of training guidelines for the Atos Work Capability Assessment two of these options are valid. The Work Capability Assessment would rate such a person as fit for work and as a result a person who is neither sick or disabled[1].

The Work Capability Assessment is carried out for those migrating from Incapacity Benefit and for new claimants to Employment Support Allowance (ESA). It was put in place by New Labour in 2008. It is administered by the French/Dutch Company Atos at a cost of 300 million. Those going through the test can be put into one of three groups.

  • ESA Support Group not required to undertake work-related activity – but will be reassessed continuously
  • ESA Work Related Activity Group, for those deemed fit for work with support and preparation. Limited to just 12 months before ESA is stopped, also may be subject to reassessment in the 12 month period.
  • Fit for Work not entitled to ESA but transferred to lower amount on Jobseeker’s Allowance

One estimate claims that up to 500,000 people have been wrongly denied Incapacity status[2]. In a 2011 February piece in the Guardian Amelia Gentlemen argues:

Since its preliminary rollout in 2008, people with terminal cancer have been found fit to work, people with mental health problems have complained their condition is not taken seriously, people with complex illnesses report that the tick-box system is not able to cope with the nuances of their problems.[3]

Citizens Advice Scotland reported that under incapacity benefits 37% were found ‘fit for work’ under Work Capacity Assessment, the figure had soaredto 66%[4]

Between October 2010 and Spring 2014 those who receive Incapacity Benefit, Severe Disablement Allowance and Income Support paid on the grounds of illness or disability will be assessed for Employment and Support Allowance. Pilots in Aberdeen and Burnley have raised more criticisms of the process adding to the raft of criticisms from the British Medical Association, the originator of the software that Atos uses, GPs, Citizens Advice Bureaus (CABs), Members of Parliament and disability organisations.

The Work Capability Assessment replaced the Personal Capability Assessment. Yet, as long ago as 2006 the Green Paper: A New Deal for Welfare: Empowering People to Work, stated  ‘the current Personal Capability Assessment process (is) already recognised by the OECD as being one of the toughest in the world’.

Case studies have shown the inhumanity of a system based on government targets and the pain and misery of the increasing stringency of these tests. One example from the 2010 report from the Citizens Advice Bureau’s report on ESA and testing procedures highlights the experiences that someone considered ‘fit for work’ by WCA might endure:

A Yorkshire bureau saw a woman in her forties who was working full-time and was enthusiastically looking forward to starting a new job, when she became ill. At first it was thought she had a viral illness, but she was subsequently diagnosed with lupus erythematosus and transverse myelitis. She was in a great deal of pain in her muscles and joints and had extreme fatigue. At times her balance was affected and she could not walk without someone to support her. Sometimes she lost sensation in her legs, and on her worst days she could not walk at all. Any exertion such as walking 40 or 50 metres led to days in bed. She had had a bad reaction to some of the treatment and an ECG showed her heart muscle had been damaged. Her husband had to come home from work each lunchtime to help her. Her immune system was weakened, so she had to be careful when mixing with others. She claimed ESA but was given six points in the Work Capability Assessment (WCA) and found capable of work. Her doctor supported her claim and she is currently appealing, but under Incapacity Benefit she would probably have been exempt and would have avoided this process

The WCA does not take into account GP assessments of an individual’s impairment or long term condition, this is ignored in favour of an, or average, 15-45 minute set of questions administered through the LiMAS software developed by Atos. LiMAS asks a set of questions for which the applicant can, but increasingly can’t, score up to 15 points which would put them in the ESA support group. As GPs who may have known applicants for all of their lives with an understanding of the medical, social and emotional impacts are ignored, a new set of individuals come into play called ‘health care professionals’. These individuals are trained by Atos for four to 16 weeks to understand targets and the all powerful LiMAS software; they are given time limits for each assessment and told that the more people they get through the better. They consist of physiotherapists, nurses and doctors usually with a general practice background or from overseas due to the notorious low pay of the multi- million pound profit Company Atos.

In 2008 The Department of Work and Pensions and Atos were severely criticised by Robert Martin the president of the appeals Tribunal Panel, a position now abolished:

Criticism was made of ATOS Healthcare medical practitioners who did not appear to pay sufficient attention to the appellant at the medical examination and who produced findings in medical reports based on observations that were inconsistent, or recorded in the medical report findings that were contradictory’[5]

In 2010 an independent review of the WCA tests by Professor Harrington concluded

There is strong evidence that the system can be impersonal and mechanistic, that the process lacks transparency and that a lack of communication between the various parties involved contributes to poor decision making and a high rate of appeals.” and that “evidence has consistently and regularly highlighted problems with each stage of the WCA process, which limit both the assessment’s fairness and effectiveness.

In a government report, Atos’s own staff said the assessments are too harsh. Prospect, the trade union who represents 135 Atos doctors, has stated that the target of seeing ten or more people a day is unrealistic and will lead to wrong assessments, especially in complex cases[6].

Despite the overwhelming evidence that WCA was not working Atos were awarded a further contract by the Department of Work and Pensions in 2010.

Figures not Identified in the Media

The figures of those considered ‘fit for work’ by Atos testing systems regularly make headlines in newspapers such as the Daily Mail, the Express, and most recently the Guardian, but little investigative journalism has been exercised in examining this apparent miracle of ‘curing of the sick and ‘the disabled’, nor looking at process, outcomes or the ways that these figures are produced.

For example, newspapers do not tell us that there has been a 56% increase in ESA appeals with figures up from 25,700 in the second quarter of 2009/2010 to 52,000 in the same quarter of 2010/2011[7]. Almost half of cases are overturned at appeal[8].Nor are we told that figures from the Department for Work and Pensions show that of those declared ‘fit for work’ by the WCA system, just 13% are in employment, 27% temporarily sick and 28% classed as permanently sick[9]. The ‘fit for work’ myth does not convert into any form of reality.

Nor is the context of the claims ever provided, a representative survey carried out by Ipsos MORI and reported in Employment and Support Allowance: findings from a face to face Survey commissioned by the Department of Work Pensions found that nearly a third of those going through the ESA process were described as having ‘literacy problems’. A further six per cent ‘problems speaking English’ and 11% had ‘numeracy problems’. Twenty two percent were described as in one or more disadvantaged groups including those with mental health issues, ex-offenders, and those with perceived learning difficulties.

An overwhelming 69% of those going through the WCA process had ‘multiple health conditions’. Those in the support group and in the ‘fit for work’ group both had the same number of ‘health conditions’ at 31.

In all groups 81% of people were receiving medical treatment for their condition, with 38% waiting for treatment or additional treatment [10] These statistics do not present us with a set of fraudsters pretending to be sick or disabled, nor a set of individuals who have been languishing on incapacity benefits for years, in fact 71% of applicants to ESA were new claimants making their first ever claim[11].

Newspaper headlines have also made much of the incomplete claims and those that ‘drop out’ of the testing system. This rhetorical demonising does not examine the process of WCA claims nor take into account the medical treatment. The first form that individuals will receive from Atos is an ESA50 form, of those surveyed almost half 46% said they found the form ‘difficult’ or that they were ‘unable to complete it’. An initial point for non-completion, others could be knocked off the system if Job Centre Plus decide that they have missed an appointment, or not responded to a letter without ‘good reason’. This would seem to complement the new punitive sanctions for universal credit and welfare reform first expressed in the Welfare Reform Bill.

The costs of tribunals, Atos contracts and the extra strain on the health service amount to a million pound fraud by successive governments. This does not count the human anxiety, misery or stress of the test, nor the suicides that have resulted because of it. Remarkably, Chris Grayling minister for employment (note minister for employment, not health or disability) said the government was making “almost constant improvements” to the WCA, but that he was “always willing to talk to the charities”, not disability organisations run and controlled by disabled then. He said “if we do something that does not prove to be the right thing, we will be happy to change it”[12]. The new set of training guidelines proves that changes have been made. However, these changes make the WCA more not less stringent, maybe the percentages of those declared ‘fit for work’ did not satisfy the existing regime.

New Training Guidelines for Atos ‘Health Care Professionals’ 2011

The training guidelines for the work capability assessment have made a number of changes which came into force in March 2011to be incorporated into a revised Work Capability Assessment. The text below is copied from the Department of Work and Pensions Training & Development Revised WCA Handbook ESA (LCW/LCWRA) Amendment Regulations 2011 version 2. The introduction states:

This handbook has been written to support Health Care Professionals (HCPs) trained in the principles of Disability Analysis; in their training and in performing medical assessments in relation to the Employment and Support Allowance Limited Capability for Work / Limited Capability for Work Related Activity (LCW/LCWRA) Amendment Regulations 2011. The amendment regulations of 2011 may also be referred to as “The Revised Work Capability Assessment” (Revised WCA).

Page 9 amazingly states: ‘The analysis of the data established that the WCA (ESA regulations 2008) was accurately identifying a person’s capability for work’.

However, an internal review produced the following recommendations. Text below is copied from pages 9-10 outlining the recommendations. Sections in bold are my own ‘disability analysis’.

Lower Limb Function

In this area, it was felt that the 2008 activities did not accurately reflect the level of function required for the modern workplace. As a result “walking” has been changed to “mobilising” to reflect the functionality of wheelchair users. It was also felt that considering standing and sitting abilities as separate entities was not relevant in the modern workplace and the new activity relates to the ability to remain at a workstation. In the 2008 descriptors, bending and kneeling were considered, however the ability to bend or kneel are no longer considered critical in the modern workplace, so this activity has been removed.

If you cannot stand, have difficulty sitting or cannot walk its OK because you have the ability to ‘remain at a workstation’ how you get to this ‘workstation’ is another matter. ‘fit for work’

 

Upper Limb Function

The review group felt that unilateral upper limb restriction would not significantly impact on an individual’s ability to work and therefore all descriptors now relate to bilateral restriction. As bilateral restriction is a significant issue, the manual dexterity scores have been revised to reflect this issue.

If you cannot move your arms, or hands presumably to type at your workstation ‘fit for work’ if you have no function in your legs but can mobilize 50 metres ‘fit for work’

Sensory Function

In the 2008 regulations, the activities in this area reflected impairment. Adaptation had not been taken into account in these areas. The review group felt that an individual’s ability to adapt must be taken into account and therefore the activity of vision has changed to the concept of being able to safely navigate. The activities of hearing and speech have been changed to the more functional concept of being able to receive communication and communicate with others.

If you are blind, deaf, Deaf or unable to speak you are ‘fit for work’ It’s about being able to safely navigate and receive communication and communicate with others, presumably with unavailable space age communication aids.

Continence

This made the assessment overly complex and thus the descriptors have been amended to reflect any loss of continence. The loss of dignity associated with incontinence has been reflected in the scoring of the descriptors.

Incontinence is too complex for the WCA but the loss of dignity is reflected in the new scoring ‘fit for work’

Consciousness

In this area, it was felt that infrequent loss of consciousness would not substantially impact on a person’s ability to work and therefore only those experiencing weekly or monthly episodes of loss of consciousness will be awarded scoring descriptors.

If you spontaneously lose consciousness once every five weeks ‘fit for work’

Mental Function

In understanding and focus, it was felt that the 2008 descriptors were complex and difficult to interpret. These have therefore been simplified. In the area of learning tasks, how an individual learns is no longer considered to be the crucial factor – it is their ability to learn that is considered. In awareness of hazard the review group felt the important issue in the workplace was to assess the level of risk for the person and others. The activity of personal action has been amended to reflect a person’s ability to prioritise and complete tasks.

In adapting to change, the highest descriptor reflects a total inability to cope with any change and is now a Support Group. In getting about, it was considered that the familiarity of a place was more important in functional terms rather than the frequency of ability to get to places.

In the area of social interaction, the review group felt the previous descriptors were rather negative in their wording and the new descriptors relate to ability to engage in social contact an individual’s ability to behave in an appropriate manner with others.

Mental functioning is too complex for the WCA it’s no longer about learning simple tasks, but an ability to learn. If you are familiar with a place (?) this is considered more important than your ability to get to that place or any place with which you are unfamiliar with (?) ‘fit for work’. If you are unable to deal with social contact that’s OK as long as you behave in an appropriate manner with others ‘fit for work’

The Decline of Welfare: the rise of private profit

Neither the PCA or the WCA were ever really centred on assessing peoples’ fitness for work; they were always part of a mutual linking between successive Government’s will to cut social claims on the state, insurance companies such as the discredited UnumProvident (now renamed Unum Group) in the early days, and private companies such as Atos’ willingness to meet targets while increasing profit.

The entire process is likely to cost the hallowed taxpayer more than the original benefits bill did, the cost of Atos contracts, the cost of tribunals, and the cost of addition health care caused by the misery of the WCA add to the higher long term costs. Yet, it’s all done under the guise of state efficiency and the market economy.

The WCA is about exploiting aspects of the social model to develop a badly mutated individualistic ‘can do’ attitude merged with a culture of blame for ‘can’t do’ aspects of bodies and minds in an increasingly disabling welfare reformist climate.

It is a publically sanctioned fraud that misrepresents and bastardises its claims to support people while simultaneously undermining the logic, and the economic and social realities of any reasonable employment criteria. In 2007 Rutherford argued:

Welfare reform exemplifies the transformation of the old style nation state into a new kind of ‘enabling’ market state. Instead of providing social protection, the market state offers ‘opportunities’ and ‘choice’ to ‘customers’, who in return must shoulder a greater degree of responsibility for their individual predicament… But the compact between the state and an individual whose life has been disrupted by disability or sickness is not an equal one… The history of the British welfare system has always been one of grudging, paternalistic and sometimes punitive forms of social protection. But even measured against its own limited ambitions, the future of welfare looks bleak[13].

The Work and Pensions Committee have launched an inquiry into the migration from Incapacity Benefits to Employment and Support Allowance, including the Work Capability Assessment.

ESA replaced incapacity benefits for people making new claims from October 2008. To be eligible for ESA, a person must usually undergo a Work Capability Assessment (WCA).

The introduction of ESA in 2008 was initially limited to new claimants. Existing incapacity benefit claimants are now being reassessed under the Work Capability Assessment. The process will last until 2014 with around 1.5 million people being reassessed.

Reassessment commenced on 11 October 2010 with a trial in Aberdeen and Burnley. At the end of February, Jobcentre Plus began a limited introductory phase, and will move to full national reassessment of incapacity benefit claimants from April 2011.

Short submissions (no more than 3,000 words) are invited from interested organisations and individuals.

The deadline for submitting evidence is 14 April 2011.
