Update on the critical Judicial Review of the legal challenge about the Minimum Income Guarantee reduction payments imposed by Norfolk County Council, scheduled for 2nd & 3rd December. The outcome of this case will affect charging policies for care and it is vital that we can show wide public interest.

Obviously our hopes of having a presence at the court have had to be revised by the lockdown and the uncertainty of when it may end and/or the tier system that will be in place when it does.

In terms of the arrangements for the hearing, the council’s lawyer has confirmed that the council would also prefer for the hearing to be held remotely. I have told the court that the parties are agreed on this, so we’ll wait to hear back. I’m fairly sure that, with MH  and SH presumably needing to shield during lockdown, and not being able to predict how long that will last for, the court will opt to hold the hearing online.

If so, we’ll send you all the details on how to access the hearing nearer the time. The court usually sends through a link the day before or the morning of the hearing, but we’re asked to provide a list in advance of people who are planning to attend since if numbers get over 100 then the court has to be advised prior to the hearing.

    Will this have any bearing in the devolved principalities, please?

    • the law differs there but I think it would mean a similar case could be taken in devolved nations if the case is won as it will set a precedent.
